Terms of Service — visz.ai

§ 1 Scope — free use of visz.ai by businesses (B2B).

§ 2 Conclusion — by registration and acceptance of these terms (and DPA).

§ 3 Service — behavioural analytics (recordings, heatmaps, funnels, forms, frustration, surveys, feedback). Best-effort, no guaranteed availability/SLA (beta, § 15). No tier/SLA sale.

§ 4 Free use and branding — the service is free; feedback and mini-banner widgets carry „Powered by Visz.ai“ (not removable in the free version).

§ 5 Paid plans — no paid plans or prices in this version.

§ 6 Payment processing — no payment processing in this version.

§ 7 User duties — lawful snippet use; valid visitor consent; PII-free custom events/tags/surveys/feedback (cf. DPA § 2).

§ 8 Availability — best-effort; maintenance and outages possible; no claim to uninterrupted operation (beta).

§ 9 Data ownership — the analytics data belongs to the user; Visz.ai never uses it for AI training or advertising.

§ 10 Software licence — simple, non-transferable right to use the snippet/dashboard.

§ 11 Prohibited use — no tracking without consent, no special categories (Art. 9), no abuse.

§ 12 Liability — for intent and gross negligence; for ordinary negligence only for cardinal duties, limited to foreseeable damage; further limited given the free service.

§ 13 Indemnity — the user indemnifies Visz.ai against third-party claims arising from unlawful snippet use (for example tracking without consent).

§ 14 Term and termination — terminable any time by account deletion; Visz.ai may terminate with notice.

§ 15 BETA NOTICE — visz.ai is in public beta. Features may change, data may exceptionally be lost, there is no availability guarantee. Use at your own risk.

§ 16 Changes to the terms — material changes 30 days in advance; right to object.

§ 17 Data protection — see the privacy policy and DPA.

§ 18 Dispute resolution — no consumer arbitration (B2B); ODR platform notice.

§ 19 Final provisions — German law, jurisdiction (where permitted), severability; the German version prevails.

In case of any conflict between the German and the English version, the German version prevails.
